ClipAI ("we", "us", "our", or the "Company") values your personal information and takes your privacy seriously. This Privacy Policy describes how we collect, use, disclose, and protect your information, and informs you of your privacy rights and how the law protects you. We strictly comply with GDPR CCPA PIPL and all other applicable privacy regulations.

2. What Information We Collect

2.1 Personal Data You Provide

  • Account Information: Your email address and password at registration (passwords are encrypted; we cannot view your plain-text password).
  • Creative Content: All text you input, images/videos/audio you upload.
  • Transaction Records: Credit purchases and consumption history.

2.2 Usage Data (Collected Automatically)

We automatically collect the following information when you use the Service:

  • Device Information: IP address, browser type and version, operating system, device unique identifiers.
  • Access Information: Access timestamps, pages viewed, time spent on pages, diagnostic data.
  • Cookies: Used only for maintaining login state and language preferences — not for advertising tracking. You can manage cookies in your browser settings.

2.3 Face Data & Media Processing

When you upload images or videos containing human faces, we may detect facial position information through on-device face detection SDKs. This information is used for:

  • Smart cropping to highlight human subjects.
  • Analyzing media content to assist AI generation (e.g., character design).
  • Filtering out media files that do not contain human faces to optimize processing.

Facial position data is processed locally on your device only and is never uploaded to our servers. Only processed content (after cropping or filtering) is uploaded for subsequent AI generation. We will not use facial data for any other purpose without your explicit consent. You may disable related permissions through your device settings at any time.

2.4 Device Permissions

To provide the full Service experience, we may request the following device permissions with your prior consent:

  • Camera & Photo Library: For uploading images and videos for AI creation.
  • Storage: For caching generated results and temporary files.

You may enable or disable these permissions at any time through your device's system settings.

3. Third-Party Service Providers

We may engage the following types of third-party service providers to support our business operations:

  • Data Analytics: To monitor and analyze Service usage, evaluate and improve product experience.
  • Cloud Storage & Hosting: To securely store your data and host our backend infrastructure.
  • Infrastructure Monitoring: To detect and diagnose performance and stability issues.
  • User Communications: To send service-related emails and notifications.

These service providers access your Personal Data only to the extent necessary to perform services on our behalf and are obligated to maintain confidentiality. We do not sell your images, videos, or audio to any third party.

  • Marketing & Promotions: With your explicit consent, sending product updates, special offers, and event information (you may opt out at any time).

  • Legal Compliance: Fulfilling legal obligations, resolving disputes, and enforcing our agreements.

Your creative content belongs to you. Always. We never use your original creative content for advertising, resale, or any commercial purposes. AI model training uses only anonymized, aggregated data that cannot be linked to any specific individual.

5. Information Sharing & Disclosure

We may share your Personal Data in the following circumstances:

  • With Service Providers: To share with the above-mentioned third-party service providers to support Service operations and analytics.
  • Business Transfers: In the event of a merger, asset sale, financing, or acquisition, your Personal Data may be transferred as part of the transaction. We will notify you via email and/or a prominent notice on our Service.
  • Affiliates: With parent companies, subsidiaries, or joint venture partners, who are required to honor this Privacy Policy.

Your data is stored on cloud servers in the United States (AWS Oregon region). By consenting to this Privacy Policy and submitting your information, you agree to such cross-border transfers. We have implemented the following safeguards:

  • Rights of Deceased's Close Relatives: Close relatives of a deceased person may, for their own lawful and legitimate interests, exercise the rights to access, copy, correct, and delete the deceased's relevant Personal Information.

8. Data Security

  • At rest: AES-256 encryption.
  • Access controls: Role-based, principle of least privilege.
  • Regular security audits and penetration testing.
  • Third-party service providers are required to sign Data Processing Agreements (DPAs).

It is important to honestly note that no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. In the event of a data breach, we will notify you and relevant regulatory authorities as required by applicable law.

9. Data Retention & Deletion

  • We retain your Personal Data only for as long as necessary for the purposes described in this Privacy Policy.
  • Usage Data is generally retained for a shorter period, except when used to strengthen security or improve Service functionality, or when a longer retention period is required by law.
  • We retain your data while your account is active to provide the Service. You may update, modify, or delete certain Personal Information in your account settings at any time.
  • After you delete your account, we will delete or anonymize all Personal Data within 30 days, unless a longer retention period is required by law.
  • Creative content you actively delete is removed from our servers immediately.
  • Even when you request deletion, we may need to retain certain information when we have a legal obligation or lawful basis to do so (e.g., to comply with regulatory obligations, resolve disputes, or enforce our agreements).

10. Links to Other Websites

Our Service may contain links to third-party websites that are not operated by us. If you click a third-party link, you will be directed to that third party's site. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

11. Children's Privacy

Our Service is not directed to individuals under the age of 16 (16 in the EU, 13–16 in the US depending on state law, and 14 in China). We do not knowingly collect Personal Data from minors. If we become aware that we have collected Personal Data from a minor without parental or guardian consent, we will take steps to remove that information from our servers.
